Events

Tarik S. Pierce Foundation (the “Foundation”) is a non-profit organization hosting several events per year (including activities related and/or incident thereto, the “Event”). By attending the Event, I will be deemed to have acknowledged and agreed as follows: 

I will comply with written or oral rules and directions of the Foundation and its representatives while attending the Event. I understand that participation in the Event has risks that may arise from my own actions or the actions of the Foundation and its representatives, other attendees, or from the site at which the Event is held. These may arise from risks from conditions at the site of the Event, including allergens, insects, dust, noise, lack of lighting, weather, use of equipment, and unforeseen acts of third parties. I understand that the Foundation may not provide security at the site, and that it may not control the conduct of other attendees or others present at the site. I understand that alcohol may be served at the Event, and other attendees may be consuming alcohol at the Event.

An inherent risk of exposure to communicable diseases, including COVID-19, exists in any place where people from different households gather. I assume all risks arising from or relating in any way to contracting a communicable disease or illness arising from my attendance at the Event.

I am knowingly attending the Event, and I knowingly assume and accept all risks of all injury, illness, disease, death, property damage or loss, financial obligation, loss of privacy, and all other consequences that may result, directly or indirectly, from my presence and participation in the Event and travel to the Event.

To the maximum extent permissible under applicable law, I waive and release the Foundation and its directors, officers, agents, employees, volunteers and affiliates, and any sponsors of Event (collectively, “Released Parties”) from any and all liability, claims, costs, and damages of any kind which I or my heirs, next of kin or legal representatives may have or which may later accrue, resulting or arising directly or indirectly from (a) my attendance at the Event or travel to the Event, including communicable diseases, and (b) any first aid, transportation or medical care provided to me in connection with my participation, except and only to the extent such liability, claims, costs, and damages is caused by the gross negligence or willful misconduct of the relevant Released Party. This waiver and release includes all claims in respect of death, personal injury, illness, property damage, loss, financial obligation, or expenses, regardless of the cause or whether such claims arise from tort, contract or otherwise. I will not sue any of the Released Parties on the basis of these waived and released claims.

I will indemnify, defend, and hold each Released Party harmless from and against any and all liability, loss, damages, claims, and attorneys’ fees it may suffer resulting or arising directly or indirectly from my participation in the Event, except and only to the extent the liability is caused by the gross negligence or willful misconduct of the relevant Released Party.

The Foundation may take photos or videos of me during the Event. I consent to the use by the Foundation of my image, voice, name and/or story in any format, including video, print, or electronic (collectively, “Materials”), as the Foundation may deem appropriate to promote future events hosted by the Foundation or for any other purposes. The Foundation may make the Materials available on its website, in its publications, or through any other media, including social networking platforms. I waive any right to inspect or approve the finished product or to receive any payment in connection with such use of the Materials. I grant to the Foundation all copyrights in the Materials and waive any legal claims relating to the Materials, including those relating to copyright or rights of publicity or privacy.

I consent to the Foundation collecting personal information from me and using it for planning, organizing, promoting, and conducting the Event or any future events hosted by the Foundation, and for following up with me after my participation in the Event or future events. I understand I may opt out from these communications.

This Waiver and Release of Liability will be legally binding on me and my heirs, next of kin, and legal representatives. I understand that the confirmations, assumptions, waivers and releases, and agreements I make in this Waiver and Release of Liability run in favor of, and may be enforced by, each of the Released Parties.
